Changes to Terms
The Seller, cbdflowerusa.com, and its associated entities and persons (“Seller”), reserves the right to modify these Terms and Conditions at any time without notice to the Buyer. “Buyer” refers to the individual, company, firm, or other legal entity purchasing the Goods. “Goods” refers to any CBD products subject to the Contract, and “Contract” refers to the mutual agreement between Seller and Buyer for the sale of Goods.

Age Restrictions
Goods may not be purchased by anyone under the age of 21. Buyer agrees that all orders may require an adult signature or other proof of age at the time of delivery.
Product Use
Buyer will not hold Seller responsible for any consequences, whether foreseen or unforeseen, nor for any harm or injury resulting from the misuse of Goods. All CBD products must be used with caution and in accordance with provided instructions. Goods are not intended as a replacement for any controlled substance or prescription medication. All products on our site comply with the 2018 Farm Bill, containing less than 0.3% THC.
Regulation and Risk of Loss
Buyer is fully responsible for complying with all federal, state, and local laws pertaining to the purchase and use of CBD Goods. Seller declares the offer of Goods void where prohibited. If Goods are lost during transport due to Buyer’s failure to comply with applicable laws, the loss is the responsibility of the Buyer. Risk of loss transfers to the Buyer immediately upon purchase.
Personal Information
Buyer affirms that all billing and shipping information provided to Seller is truthful, accurate, and pertains solely to the Buyer, not any third party.
Right to Refuse Sale
Seller reserves the right to refuse sale or service to anyone for any reason. Goods will not be sold or shipped to Buyers in states or jurisdictions where CBD products are prohibited, including but not limited to Idaho, Iowa, and South Dakota.

Severability
The validity of these Terms and Conditions is not affected if any term is deemed legally invalid, illegal, or unenforceable. Each term exists independently and remains valid regardless of changes to others.
EU Customers
Any disputes involving EU customers will be handled within the EU.
Choice of Law and Venue
These Terms and Conditions and any sale of Goods are governed by the laws of the State of Nevada. All disputes or proceedings related to the sale of Goods or these Terms shall be litigated exclusively in the State or Federal Courts of Nevada. Buyer waives any right to contest this exclusive venue.
Disclaimer of Liability
Goods and information provided by Seller are offered “AS IS” without warranty, express or implied, including warranties of merchantability or fitness for a particular purpose. Seller is not liable for any damages or injuries resulting from the use, misuse, or improper use of Goods, nor for actions taken based on information or views obtained through Seller. Buyer agrees to indemnify and hold harmless Seller and its affiliates from any damages resulting from the purchase, use, or misuse of Goods.
Buyer Affirmations
By purchasing Goods, Buyer affirms:
- I am over 21 and an adult under the laws of my State and Country.
- I am in good health, of sound mind and body, and capable of making my own decisions.
- I understand that Goods are provided “AS IS” without warranty.
- I agree to abide by all cautions and warnings regarding product use.
- I have researched and will comply with all applicable laws regarding CBD products.
CBD Compliance

CBD is legal in most U.S. states but may be restricted in certain jurisdictions, including Idaho, Iowa, and South Dakota. Buyer is responsible for ensuring compliance with all applicable laws, as regulations may change frequently.
Dispute Resolution
Any dispute, claim, or controversy arising from these Terms, the sale of Goods, or related matters will be resolved through binding arbitration in Sparks, Nevada, under the Commercial Arbitration Rules of the American Arbitration Association (AAA). The arbitrator shall apply the substantive laws of the Federal Judicial Circuit where cbdflowerusa.com’s principal place of business is located, without regard to conflict of laws rules. The arbitrator must have at least five years of experience and knowledge of the dispute’s subject matter. If no arbitrator is agreed upon within 10 days, the AAA will appoint one.
The AAA’s rules for Emergency Measures of Protection apply in lieu of seeking court-ordered injunctive relief. The arbitrator’s decision is final, with no appeal rights except as provided in section 10 of the Federal Arbitration Act (FAA). Each party bears its share of arbitration fees, though the arbitrator may reallocate fees in a reasoned decision. The arbitrator may award attorneys’ fees only as authorized by statute or contract. No punitive damages may be awarded, and class arbitration or representative claims are not permitted. Arbitration details remain confidential unless required by law. If any provision of this section is invalid, it does not affect the remaining provisions. If a dispute proceeds in court, both parties waive the right to a jury trial. This arbitration provision survives termination of participation in any Seller programs.
